Fake Hirst on eBay Real Hirst in Doha

Two California gallery owners were arrested on Oct 2, 2013 for allegedly selling fraudulent Damien Hirst pieces online through eBay and various auction houses.  (Damien Hirst is a world-famous English artist associated with the Young British Artists movement and is known for his controversial paintings, sculptures and large-scale installations).[1]  The two men, Vincent Lopreto and Ronald Bell, own and worked at JazzArtz, a gallery in Laguna Beach.[2]

Undercover officials coordinated with the Manhattan District Attorney to purchase several of the forged pieces online.  Detectives in Laguna Beach conducted surveillance of the two individuals and witnessed the mailing of the phony pieces.  Search of the gallery yielded additional counterfeit Hirst works of art, fake certificates of authenticity and tools used to make reproductions.  The investigation also revealed possible victims across the globe from South Korea, Spain, Italy, the Netherlands and Japan.[3]

Lopreto and Bell were held on New York arrest warrants for fraud, attempts to defraud and identity theft in the first degree.[4]  Incidentally, Lopreto was arrested in 2008 for the fraudulent sale of various Damien Hirst paintings through eBay and was sentenced to prison for five years.[5]

While fraudulent sales through eBay are nothing new, such schemes do raise questions about eBay’s potential liability in this case.  Situations like the present one often involve IP rights owners attempting to hold eBay liable on a theory of contributory negligence for allowing the infringing materials to be sold through its channels.  However the current state of the law appears to protect eBay from such suits.

For example, Sec. 512(c) of the Digital Millennium Copyright Act (DMCA) provides a safe harbor for online businesses such as eBay.  This provision states that if an internet service provider does not have actual knowledge of the existence of infringing material or activities on its site then it can not be held vicariously liable for violations of third parties.  However if the rights owner provides notice of the infringing activity to the internet service provider then the service provider must act promptly to take down the offensive material or subject itself to liability.[6]

The 9th Circuit’s decision in Fonovisa demonstrates that in order for a service provider such as eBay to be held liable on a theory of contributory copyright infringement, it must be found to (1) have “knowledge of the infringing activity” and (2) “induce[], cause[], or materially contribute[] to the infringing conduct of another”.[7]  Clearly eBay satisfies the second prong of the 9th Circuit’s test in this situation.  eBay “materially contributes” to a third party’s infringing conduct by providing the channel through which counterfeit works of art are sold.  The problem is the first prong.  While eBay has general knowledge that infringing activity occurs on its website (evidenced by the various take down policies it implements),[8] it is difficult to show that eBay has specific knowledge that a particular seller is engaging in conduct that infringes on the rights of the copyrights owner.[9]

While it is clear that Lopreto and Bell will be subject to criminal penalties, it is unlikely that Damien Hirst (assuming he owns the rights to these works) has a viable claim against eBay unless he can show that eBay knew of the infringing conduct and did not promptly act to remedy the infringing activity.  It seems that at present, Damien Hirst is otherwise occupied with commissions from Doha’s Museum Authority as evidenced by the series of sculptures unveiled at the Sidra Medical and Research Center and the decoration of the exterior of the Al Riwaq exhibition space.[10]

Join the Center for Art Law for a conversation wit Join the Center for Art Law for a conversation with Dr. Rubina Raja, Professor of Classical Archaeology and Art at Aarhus University, as she presents contemporary, collaborative approaches to combating the illicit trade in antiquities, with a particular focus on Palmyra (Tadmor), Syria.

Drawing on the historical relationship between collecting and looting, the discussion will highlight the Palmyrene Portrait Project, a corpus of over 4,000 funerary portraits from Palmyra compiled by Dr. Raja and her team since 2012. The project serves as a critical record of material that, in many cases, remained in situ prior to the outbreak of the Syrian Civil War. 

Before its inception, this body of material had not been treated as a unified corpus, nor systematically digitized. Today, the project stands as both the largest corpus of individual Roman period portraits from a single urban context and an essential scholarly and practical tool for identifying objects from Palmyra as they emerge on the art market.

On October 6, 2025, the Flemish Government announc On October 6, 2025, the Flemish Government announced plans to transform the Museum of Contemporary Art Antwerp (M HKA) into an art center — a change that would make the institution lose its legal museum status and transfer its collection to the Stedelijk Museum voor Actuele Kunst in Ghent. Losing this status will have huge legal, financial, and cultural repercussions for the M HKA. 

This decision raised strong reactions from the art world, denouncing the false administrative logic behind this reorganization, which, according to the Flemish Minister of Culture, aims to strengthen collaboration and coherence within the cultural landscape. How does this transfer truly impact the Belgian artistic landscape — and does it really contribute to any coherence, or does it instead destroy the long-term curation and expertise that the institution has built in Antwerp?

In 1935 Ernst Magnus was forced to sell "The Virgi In 1935 Ernst Magnus was forced to sell "The Virgin and Child with Saint Anne" and other works in order to escape the Nazi regime. In 1941 the painting was sold to Hermann Göring and was then recovered by the Allies at the close of World War II. By the 1960s the painting was held by the Bayerische Staatsgemäldesammlungen.

Originally restitution was rejected, but under expanded guidelines the Museum chose to restitute the piece  to Ernst Magnus' heirs. It is now set to be Auction by Sotheby's on June 2, 2026. The starting bid is listed at $28k and the estimated price between $40-60k.

Historical context — as illustrated by World War II-era cases — or, in the modern world, the lack of due diligence and risk assessment and failures of authentication, show how a combination of factors allows forgeries to flourish in particular contexts. 

From a legal perspective, fraud and forgeries are not the only issues complicating the operation of the art market. They are further amplified by related problems such as money laundering, fraud schemes, and theft. In this context, due diligence and authentication become even more critical considerations for buyers and sellers.
