In recent years, the Italian government has had ma

In recent years, the Italian government has had many victories in tracking down art thieves. On May 24, 2023, Carabinieri police arrested sixteen people and recovered 3,500+ ancient Greek and Roman artifacts. Among the artifacts are coins, jewelry, plates, cups, jars, and miniatures dating from the 4th century BC to the 3rd century AD, which have significant historical, artistic, and commercial value. The items will be showcased at the Museum of Rescued Art inaugurated in 2022 in Rome before returning to their origins.

The arrested face charges including criminal conspiracy, illegal digging, theft, trading in stolen goods, and illegal export of goods.

About the speaker:
Stanley Bulua has been practicing law for more than 40 years and concentrates in the areas of ESOPs, estate planning, estate administration and income tax.

In the estate planning area, Stan has advised his clients with respect to the use of sophisticated trust and estate planning techniques involving both lifetime and testamentary transfers. These techniques have included the use of complex wills, irrevocable trusts, qualified personal residence trusts, grantor retained annuity trusts, defective grantor trusts, charitable remainder trusts, family limited partnerships and limited liability companies. Stan has also represented executors and trustees in the administration of trusts and estates and is well versed in advanced post-mortem techniques of estate administration.

Stan’s ESOP practice involves the design, structure, negotiation, and documentation of complex ESOP transactions involving bank financing, seller financing through subordinated notes and warrants, stock redemption agreements, stock purchase agreements and ESOP exempt loan documents. He has vast experience in the design and implementation of ESOPs to deal with a broad range of business succession issues. Stan also has significant experience advising ESOP-owned companies on matters involving corporate governance and fiduciary responsibilities and has successfully represented ESOP companies and fiduciaries in connection with proceedings involving the U.S. Department of Labor and the Internal Revenue Service. Stan is well recognized in the ESOP area and has lectured to professional groups on many aspects of ESOP practice.

For income taxation, Stan advises individuals, partnerships, trusts, limited liability companies and corporations on income tax issues affecting their operations and businesses. He has also represented individuals and entities on contested tax matters.

About the Speaker:
Darlene Bialowski, principal of Darlene Bialowski Art Services, LLC, has been in the museum and cultural heritage preservation field for more than 25 years working as a Curatorial Assistant at Memorial Hall Museum in Deerfield, MA; to being the sole Registrar for the then four Springfield Museums in Springfield, MA as well as overseeing two satellite exhibition sites at Smith & Wesson’s headquarters and its Shooting Academy; to being an independent contract Registrar.

She is also an author, lecturer and co-founder and President of the non-profit Collections Care & Conservation Alliance, an Immediate past President of Red Arch Cultural Heritage Law & Policy Research as well as a past President of the Center for Painted Wall Preservation. Darlene sits as a Consultant on both non-profit boards. Darlene is also an accredited member of the Appraisers Association of America with her appraisal specialties in fine and decorative arts. With her extensive backgrounds in the fields of collections care, art, cultural preservation, appraising and being a former paralegal, Darlene’s expertise and broad network of colleagues and experts assist her in aiding clients directly or being able to make the right introductions if necessary.

If you missed the uncanny scene of a Yayoi Kusama look-alike robot painting dots onto the shop windows at Louis Vuitton’s Fifth Avenue store in New York or at the Place Vendôme location in Paris, you must have spotted elsewhere the omnipresent campaign that unleashes the second collaboration between the fashion house and the artist. Dubbed “Creating Infinity” collection, LV x Kusama (2023) includes over 450 bags, perfumes, accessories, and shoes.

The over the top project drew crowds and some loud criticism from artists and members of the public, prompting questions about artistic legacies of aging artists, exploitation of IP, copyright and wrong, and consent. Hilde Lynn Helphenstein (a.k.a Jerry Gogosian), a veteran art world satirist with 126k Instagram followers, asked why “pumping out a line of handbags” would be a priority for the nonagenarian living in a hospital for mentally ill.

Jerry spoke to the Center about her concerns about the artist’s involvement in the“Creating Infinity,” collection’s erosive impact on Kusama’s legacy, and her own distressing experience in connection with LV x Kusama campaign.

Let's talk about Estates of Art Collectors

On May 11, 2023, Christie’s commenced New York's spring sale series with a $178 million sale of art from the estate of the late Condé Nast chairman S.I. Newhouse Jr. 7 out of 16 pieces in the cache are sold above $10m. Here is a partial rundown of the sale:

A 1947 Willem de Kooning, "Orestes," that Mr. Newhouse won for $13.2 m in 2002 resold for $31m.

Bacon's 1969 "Self Portrait", purchased by S.I. Newhouse for $8.9 million in 2006, sold for $35m.

Jasper Johns' 1971 "Decoy” underperformed. It was estimated to sell for at least $14m but only sold for $10.7 million.

The marketplace is undergoing a generational taste shift among younger buyers who want a broader canon of artists. The mixed result calls for different forcasts on whether estates of art collectors will still sell. Do you agree that some art is timeless and will be forever in demand or will they become less appealing?
