Cultural Heritage, War and Geopolitics: The Case of Ukraine

This seminar delves into the intricate role of cultural heritage in light of Russia's aggressive war against Ukraine. Recent conflicts, marked by mass atrocities and terrorism, often revolve around matters pertaining to cultural heritage—be it places, objects, or narratives of profound cultural or spiritual significance. This extends beyond the physical destruction of locations observed during times of kinetic conflict, encompassing strategies aimed at influencing and destabilizing communities and nations. In some cases, the weaponization of historical and cultural narratives has become a prominent tactic. Undoubtedly, cultural heritage emerges as an inherently geopolitical issue and, increasingly, a distinct military domain. Claims to cultural heritage underlie territorial disputes, acts of aggression, information warfare, and military invasions.
How do Russia and NATO countries perceive cultural heritage within the framework of national security? How can we comprehend aggressions such as Russia’s in this realm, and what measures can be taken to counter it?

After many years of a persisting stalemate over the Parthenon Marbles, change may be in the air. Join us at Fladgate LLP in London on 7th December for a discussion of IAL Director Alexander Herman’s new book, The Parthenon Marbles Dispute: Heritage, Law, Politics. The book features an investigation of the causes of the longstanding conflict and proposes new ways ahead. In addition to the author, speakers will include Mark Stephens CBE, Sir Alan Moses and Dr Debbie De Girolamo. The book was released on 21 September as the first title in the Art Law Library series published by Hart Publishing (part of Bloomsbury) in partnership with the Institute of Art and Law.

Join the Center for Art Law as we discuss the intersection of divorce and the world of art in New York. Our expert panel, comprising Magnolia D. Levy, a matrimonial and family law attorney with LoPreto + Levy, LLP in New York City, Courtney Christensen, Senior Director of Trusts & Estates at Winston Art Group and Irina Tarsis, Founder of the Center for Art Law, will guide us through the complex landscape of acquiring and dividing assets, with a focus on high-value art collections. Our speakers will also guide us through the process of art acquisition during marriage and division of such art assets acquired before marriage and during marriage.
The panel will explore the concept of property--whether it is separate property (either pre-marital or acquired during the marriage as separate property) or marital property, and the methods of ascertaining ownership, whether through bills of sale, invoices, or other legal documentation. The session will also look into the valuation of art with real-world examples, including the landmark Macklowe case, among others, to understand different approaches such as fair market value and marketable cash value, and the impact of valuation on the division of that art.

What's there to talk about?! A quarter century after the signing of the Washington Principles and 80 years after the London Conference which produced a public statement that taking of property by the Nazis will not be recognized by the art world once the World War 2 would come to an end, in 2023 the world is still dealing with Nazi-era looted art claims and disputes. While the leading art museums are engaging with experts to review provenance of art long in their care, courts and auction houses still grapple with restitution claims. Conflicts of law, statutes of limitation and loss of memory and evidence make outcomes of claims for recovery of art intentionally or opportunistically looted during World War 2, hinder our ability to find and reach fair and just solutions.
To mark this anniversary with an informal conversation and to acknowledge that fairness is not guaranteed in cases involving art claims, join us to hear from the Center's in house expert: our Board of Advisors' member Jen Kreder (author of amicus briefs and numerous articles about Nazi-era looted art cases), our Board of Director's Peter Toren, plaintiff in the recently decided Toren v. The Fed. Republic of Germany. Moderated by Irina Tarsis, Founder of the Center for Art Law, let's think whether the US still needs or ever needed a Commission to Resolve Nazi-era Looted Art Claims. We will discuss the recent developments in cases citing the HEAR act and in trends that Nazi-era looted art cases are setting for 2024.

"You've been Served" -- a movie ticket, a discussion and a drink. Join us this November in style, together in the heart of New York City, contemplating our common value systems and duties (if any) of various art market participants.
Made You Look: A True Story About Fake Art (2020) is a documentary film directed by Barry Avrich. The film depicts the various dealers, collectors and gallery owners who found themselves embroiled in the largest art fraud in American history.
At the center of the early-2000s scandal was Ann Freedman, the director of Manhattan’s once-prestigious Knoedler Gallery. Her fateful meeting with Glafira Rosales, a quiet woman who had access to a treasure trove of Abstract Expressionism purportedly by the likes of Jackson Pollock, Willem de Kooning and Mark Rothko, eventually would amount to an $80 million con.
Although the works passed muster from respected authenticators, things became a little murkier when it came to the equally important matter of provenance, which was ultimately traced back to Queens, where they were forged by an unassuming Chinese math professor.
The film features interviews with prominent voices in the art world, a rich depiction of the development and fallout of this consequential case, as well as interviews with Freedman herself.
A discussion will follow the screening with Director Barry Avrich.

The Victoria and Albert Museum’s Culture in Crisis Programme, in partnership with the REVIVE Campaign, will host a hybrid in-person and online seminar exploring the past, present and future of damage and destruction to cultural heritage as a result of conflict and war in the Middle East. Bringing together experts from different fields, the session will be an opportunity to hear current research and concerns around the impact of conflict on heritage and what can be done to mitigate the risks and to restore cultural heritage that has been damaged or destroyed.
There will be a networking session after the presentations for in-person attendees.
